Sobre la vigencia de la denominada “captura administrativa” en el ordenamiento jurídico colombiano

This article is part of a more elaborate text by the author, entitled “Control of the Legality of the capture by the Trial Judge in the adversarial model of Act 906 of 2004”; and in it, a study is carried out in relation to the validity of the well-known among us figure of “administrative capture.” Figures in this, if it is true was expressly stated in the second paragraph of Article 28 of the Constitution of 1886, given the political authoritarianism of it, it is not less than even though it was not accepted within the 1991 National Constituent Assembly, by jurisprudence, the Constitutional Court derived its existence and resurrected in our legal system; however, later that same constitutional court, under a pro-libertarian perspective and more stringent endpoints of the fundamental right to freedom, ended recognizing that it was not in effect in Colombia. The previous thesis which was duly supported by the Supreme Court.El presente artículo forma parte integrante de un texto más elaborado del autor, titulado “Del Control de Legalidad de la captura por el Juezde Garantías en el modelo acusatorio de la Ley 906 de 2004”, en el cual se realiza un estudio en relación con la vigencia de la “captura administrativa”. Figura esta que si bien se encontraba expresamente consagrada en el inciso segundo del artículo 28 de la Constitución de1886, dado el autoritarismo político de ella, no lo es menos que muy a pesar de que la misma no fue acogida en el seno de la AsambleaNacional Constituyente de 1991, por vía de jurisprudencia, la Corte Constitucional derivó su existencia y la hizo resurgir en nuestroordenamiento jurídico; empero, con posterioridad, ese mismo tribunal constitucional, bajo una óptica pro-libertaria y unos más rigurososparámetros de valoración del derecho fundamental a la libertad, terminó reconociendo que no tenía vigencia en Colombia.
